Sons and daughters of Spanish citizens are entitled to Spanish Nationality. Article 11 of the Spanish Constitution of 1978 and Articles 17 to 26 of the Spanish Civil Code guarantee nationality in two modalities: original and derived.

By the original modality Spanish citizens’ direct sons and daughters may obtain or opt for Spanish Nationality. The Spanish legislation declares that the document able to prove nationality is the birth certificate of the Spanish ancestor.
